WTO.越南通报关于 汽车制造、组装和进口、汽车保修和维修服务业务要求的第116/2017/ND CP号法令若干条款修订和补充法令草案

越南谨通知世贸组织成员，在G/TBT/N/VNM/116/Add.1号通知中通知的修订关于汽车制造、组装和进口、汽车保修和维修服务业务要求的第116/2017/ND-CP号法令草案已于2020年2月5日在第17/2020/ND-CP号法令中颁布。
详细颁布的规定如下：
1.该法令补充了关于暂停发放许可证的条例，如果企业进口或暂时进口装有侵犯越南社会主义共和国主权、统一和领土完整的地图的导航软件的汽车，则吊销其许可证。特别是：
1.1对进口、临时进口汽车，安装导航软件，违反越南社会主义共和国主权、统一和领土完整，将暂停发放汽车进口营业执照。自停业之日起6个月内，对违规企业全面克服违规行为的，将考虑取消暂停。企业自停业之日起未办理的，吊销其进口营业执照。
1.2此外，第17/2020/ND-CP号法令还修订了关于进口未使用汽车质量的规定。对于采用车型认证管理的国家生产的进口汽车，质量管理部门根据代表性样品的技术安全环保检测结果和制造厂的质量保证条件评价结果，对车型进行评价。对实行自行申报管理的国家生产的进口汽车，质量管理部门应当根据代表性样品的技术安全和环境保护检测结果和市场抽样检验结果，对车型进行评价。
1.3最大类型评估频率为36个月。
二、越南交通部负责根据现行产品质量法规和上述法令，对国产、组装汽车、进口汽车的技术安全和环境保护检查进行详细规定和指导
3.第17/2020/ND-CP号文件《汽车制造、装配和进口业务要求、汽车保修和维修服务规定》已于2020年2月5日生效。

Viet Nam would like to inform the WTO Members that draft decree amending Decree 116/2017/ND-CP on business requirements for manufacturing, assembly and imports of automobiles, automobiles warranty and maintenance services, which was notified in notification G/TBT/N/VNM/116/Add.1 has been promulgated in Decree No.17/2020/ND-CP on 5 February 2020.
The detailed promulgated provisions are as followed:
1.The Decree supplemented the regulation on suspending the validity and revocation of license granted to enterprises in case they import or temporarily import automobiles which were installed navigation software with maps violating the sovereignty, unity and territorial integrity of the Socialist Republic of Vietnam. Specifically:
1.1Validity of automobile import business licenses granted to the enterprises who import or temporarily import automobiles which were installed navigation software with maps violating the sovereignty, unity and territorial integrity of the Socialist Republic of Vietnam will be suspended. Within 06 months from the date of suspension, if the violated enterprise comprehensively overcomes the violation, cancellation of such suspension will be considered. In case the enterprise fails to do so from the date of suspension, their import business licenses shall be revoked.
1.2In addition, Decree 17/2020/ND-CP also amended the provision on quality of imported unused automobiles. For imported automobiles manufactured by countries where management by vehicle type approval is applied, the quality management authority shall evaluate the vehicle type based on technical safety and environment protection testing and inspection results of representative samples and quality ensuring conditions evaluation results in manufacturing facility. For imported automobiles manufactured by countries where management by self-declaration is applied, the quality management authority shall evaluate the vehicle type based on technical safety and environment protection testing and inspection results of representative samples and inspection of samples taken on the market.
1.3Maximum type evaluation frequency is 36 months.
2.Viet Nam Ministry of Transport is responsible for detailing and guiding the inspection of technical safety and environment protection for domestically manufactured and assembled automobiles and imported automobiles in accordance with existing legislation on products and goods quality and above-mentioned Decree
3.Provisions on business requirements for manufacturing, assembly and imports of automobiles, automobiles warranty and maintenance services in Decree 17/2020/ND-CP has come in force on 5 February 2020.
