 1. 加拿大通报《汽车安全法》下若干法规的修正案通过 (缺陷通知书及不符合规定通知书)

    2019年6月22日,G/TBT/N/CAN/558(2018年6月30日)中提出的修改意见被通过,成为《机动车安全法(缺陷通知和不符合规定通知)》中关于修改部分的新规。该修正案修订了现行的规定,并对以下三项规定中的每一项增加了缺陷通知或不遵守通知的新要求。这三项规定为:《机动车安全规定》、《机动车轮胎安全规定》和《机动车制动系统和助力器座椅安全规定》。

Regulations Amending Certain Regulations Made under the Motor Vehicle Safety Act (Notice of Defect and Notice of Non-compliance)
The proposed amendment notified in G/TBT/N/CAN/558 (dated 30 June 2018) was adopted on 22 June 2019 as the "Regulations Amending Certain Regulations Made under the Motor Vehicle Safety Act (Notice of Defect and Notice of Non-compliance)".
The amendment revises current prescriptions and adds new requirements for giving a notice of defect or notice of non-compliance, to each of the following three regulations under the authority of the Motor Vehicle Safety Act; the Motor Vehicle Safety Regulations, the Motor Vehicle Tire Safety Regulations and the Motor Vehicle Restraint Systems and Booster Seat Safety Regulations.
The amendment requires that vehicle and equipment companies required to give a notice of defect or notice of non-compliance: a) provide greater clarity and relevant detail in their notices; b) revise their notification process to address a non-compliance separately from a defect; and, c) augment reporting requirements associated with these notifications. It also requires that companies provide, in the vehicle owner's manual, instructions on how to contact Transport Canada to report a safety concern related to the vehicle.
The new requirements for giving a notice of non-compliance mirror those for giving a notice of defect, with slight differences to address the characteristics of non-compliance, including those deemed to be inconsequential to safety.
Reporting requirements strengthen the existing reporting and oversight provisions, including standardizing requirements across the three regulations, requiring companies submit, to the Minister, copies of any subsequent communications to owners and retailers for a period of five years, and aligning submission dates for quarterly reports with the United States' schedule.
Motor vehicle and equipment manufacturers and importers are responsible for ensuring compliance with the requirements of the Motor Vehicle Safety Act and its regulations. The Department of Transport monitors the self-certification programs of manufacturers and importers by reviewing their test documentation, and inspecting and testing vehicles and equipment obtained in the open market.
The amendment to these regulations comes into force on the date of publication in the Canada Gazette, Part II, which is 10 July 2019. The full text of the adopted measure can be downloaded from the Internet addresses indicated below:

This draft Consumer Goods (Quad Bikes) Safety Standard 2019 specifies the requirements of the design, performance and construction of quad bikes and the form and content of markings and warnings to accompany them.
The objective of the Consumer Goods (Quad Bikes) Safety Standard 2019 is to reduce the number of fatalities and the severity of injuries associated with the use of quad bikes in Australia. In particular those caused by rollovers often resulting in the rider being crushed or asphyxiated. It does this by: - improving the safety information available to consumers - introducing minimum design, performance and construction requirements to all quad bikes through the adoption of certain sections of the US or European quad bike standards - providing operators increased protection from being crushed or pinned by the quad bike in the event of a rollover - reducing the frequency of rollovers of general-use model bikes by introducing minimum stability performance requirements; Consumer information, labelling; Protection of human health or safety
