China’s Supervision System for International Bidding of Mechanic and Electronic Products Takes Shape

It is effective for MOFCOM to make positive response to challenges by the public



Through the exploration and practice over the past 20 years, China’s management rules and operation modes of international bidding for mechanic and electronic products have been accepted by relevant parties, becoming the common codes. A standard and transparent international bidding market consistent at home and abroad with orderly competition for mechanic and electronic products is forming.



This unified market is supported by five systems: legal construction system, supported by Bidding Law and Administrative License Law; bidding agent system, made up of 206 international bidding organizations nationwide; system of experts, made up by 24,000 experts covering 761 industries of 43 categories; network system, the professional website China international bidding net (www.Chinabidding.com) with multi-functions and the biggest scale nationwide has been set up; administrative supervision system, with the powerful two-level supervision and administration of the central and local governments.



According to Department of Mechanic, Electronic and Hi-tech Industry (National Mechanic and Electronic Import and Export Office), international bidding has not only become a crucial measure to introduce important technologies in an open environment, but also enhanced independent innovation capacity and core competitiveness of domestic enterprises, making China’s industrial structure optimized and investment benefits increased. During the 11th Five-Year Plan period, international bidding has saved about US$21.88 billion for enterprises, with fund-saving rate of 14.8%. More over, it significantly reduced administrative intervention and power rent-seeking, and eliminated the systematical and mechanical factor that breeds corruption and business bribery to some extent.



In order to create a fair, equal and just market environment, MOFCOM has intensified supervision over bidding parties, before, during and after bidding, adopted new supervision method to respond and deal with social challenges in a timely and appropriate manner, so as to take concrete steps to strengthen administrative supervision. On one hand, we paid efforts to perfect the mechanism for dealing with challenges in international bidding, and carried out special administration action, with 144 challenges in international bidding resolved according to law last year, which guaranteed the successful implementation of national major projects such as airports, high speed rails and rail transportation. In response to recurrent of malicious challenges in international bidding in civil aircraft business, we specially researched and issued guiding opinions, adjusted rules on administrative supervision in international bidding for mechanic and electronic products, further defined supervision scope and time limit, which made the case of unlawful challenges down remarkably. On the other hand, we attached importance to credit building. We opened information release column in the bidding net, made public the bid inviter and bid inviting organization challenged and the detailed situation challenged by the bidder and the final treatment, which made parties in the bidding activities more self-disciplined and prevented disordered competition. In 2011, quantity of challenge cases in international bidding continued to decline, down by 23.8% year on year.
